Recreational, Social and Athletic Activity, Facility, and Equipment Use Waiver and Release Form

We understand the importance and health benefits of recreational, social and athletic activities. There are, however, many factors that need to be taken seriously before you engage in the use of the Hansen’s Gym and any related equipment made available by the Hansen Family (collectively the “Hansen Gym”). Before you use the Hansen Gym, you must read, sign, and return this Waiver Release Form to Travis Hansen. Waiver and Release of Liability Express assumption of risk: I, the undersigned, am aware that there are significant risks involved in physical activities and the use of the Hansen Gym and any related equipment being made available by Travis Hansen, and that my participation in any such activity or activities and use of the Hansen Gym carries with it the potential for death, injury, and/or property damage. The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of myself, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; exposure to viruses, contagions or other diseases (including but not limited to SARS-CoV-2); those risks caused by facilities, temperature, condition of athletes, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and trainers and lack of hydration. These risks are not only inherent to recreational activities and athletics but are also present for volunteers and spectators. I am aware that any of these above-mentioned risks may result in serious injury or death to myself and or others. I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any recreational, social and/or athletic activity or from use of the Hansen Gym facilities and/or equipment identified above. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them or because of their possible liability without fault. I represent and acknowledge that I have no physical impairments, injuries, or illnesses (including but not limited to COVID-19 and have not been exposed thereto) that will endanger me or others and that I have no reason to believe that I am physically, mentally or emotionally unable to safely participate in the activity or activities I chose to participate or to use the facilities and/or equipment provided by Travis Hansen and his family.

Release: I acknowledge that I am willingly using the Hansen Gym and am willingly participating in any activities using those facilities and/or equipment and that I have assumed all risks as described above. In consideration for my being allowed to use the Hansen Gym and to participate in the activities offered, I, the undersigned hereby release Travis Hansen, his family, their affiliated entities, and their principals, officers, agents, employees, contractors, and volunteers (collectively the “Hansen Parties”) from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my use of the Hansen Gym or with my participation in any activity or activities using any related facilities and/or equipment, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties or others. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.

Indemnification: I recognize that there is risk involved in the use of the Hansen Gym. Therefore, I accept financial responsibility for any injury that I may cause either to myself or to any other party using the Hansen Gym due to my negligence. Should any Hansen Party be required to incur attorney’s fees and costs to enforce this Waiver and Release, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless the Hansen Parties from liability for the injury or death of any person(s) and/or damage to property that may result from my acts or omissions (whether negligent, intentional, or otherwise) while using the Hansen Gym. Governing Law & Venue: The laws of the State of Utah shall govern this agreement (without reference to its principles of conflicts of law), and venue for any proceeding arising out of my participation in the activity or activities for which I have enrolled or this agreement shall be in Salt Lake County in the State of Utah, and any right to a jury trial is hereby waived by me.

I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it I am obligated to indemnify the Hansen Parties for any liability for injury or death of any person and damage to property caused by my acts or omissions (whether negligent, intentional, or otherwise) while using the Hansen Gym. I understand that by signing this form I am waiving valuable legal rights.

Guardians of Minors using the facilities/equipment must review and complete the section below. I hereby certify that I am the adult parent or guardian of [child's name listed below], a minor child under the age of eighteen years (the “Minor”), and I consent to his/her participation in recreational activities at the Hansen Gym. I understand and acknowledge that I am fully aware of and assume the risks (including but not limited to the risk of death, serious bodily injury, or property loss or damage) arising out of the Minor’s use of the Hansen Gym. I allow the Minor to use the facilities listed above. I agree that I am bound by the Express Assumption of Risk, Release, Indemnification, Governing Law & Venue agreements, obligations and provisions I have initialed above on behalf of myself and the Minor. I am at least eighteen years of age and have carefully read and freely signed this Waiver and Release Form and agree to be bound by its terms.
